The website accessible at http://www.zmart.cn, including any other Internet addresses referring to it (collectively referred to as the ‘website’), is operated by Zentek GmbH & Co. KG. Please consult the Imprint for information on how to contact it. Zentek takes data protection and the legal obligations in conjunction with it very seriously. This Data Protection Declaration explains to you which data is being collected and processed on our website when contacting Zentek and in our business processes. It also explains the way in which this data is being used and how Zentek warrants the safety of your data.

The personal data that Zentek receives from its customers or from other data subjects is processed by Zentek for the purpose of contract fulfilment or for the implementation of pre-contractual measures. To the extent required for performing our services, Zentek also processes personal data lawfully acquired from publicly accessible sources (e.g. register of debtors, company and association registers, media, Internet) or lawfully transmitted to us by other third parties (e.g. credit rating agencies).

2. Personal Data

Personal data is data that enables the ascertainment of the identity of the users or customers of this website. It includes, among other things, the surname, first name, postal address, telephone number, and e-mail address. It is basically possible to use our website without you having to wholly or partially disclose your identity.

It is only for contractual or pre-contractual measures or when contacting Zentek, e.g. via the website, that the disclosure of your identity and the divulging of your personal data is required. Without the disclosure of your identity and the divulging of your personal data it is not possible for Zentek to process your request. You are therefore free to decide whether you want to transmit personal data to us for the purpose of contacting us.

3. Automatic Data Processing on the Website

The website is made available by a computer specialized for this purpose (‘server’). It automatically collects information every time the website is accessed and stores this information in written records (‘log files’). This comprises (1) the browser used, including its version number, (2) the operating system used, (3) the address of the preceding website visited by you (‘referrer URL’), (4) the address of the computer from which you accessed the website (‘IP address’), and (5) the time and date of accessing this website. The aforementioned information is transmitted by your browser unless you have prevented this through your browser settings or through a security software used by you. Zentek is unable to allocate to a specific person the data stored by the server in the log files. The data in the log files of the server is also not being combined with other data sources that may be available to us.

4. Use of Your Data

Zentek processes personal data in line with the provisions of the General Data Protection Regulation (Regulation (EU) 2016/679) and the [German] Federal Data Protection Act (BDSG) in the following instances:

a) when you have consented to it,

b) when a contract exists or for implementing pre-contractual measures (if requested),

c) when processing is required in order to fulfil a legal obligation,

d) when processing is required to protect the vital interests of the data subject or of another natural person,

e) when processing is required in order to exercise a task that is in the public's interest,

f) when processing is required to safeguard our or a third party’s legitimate interests unless this is outweighed by the data subject’s interests or fundamental rights and fundamental freedoms that demand the protection of personal data.

If you contact us via the website, the personal data requested of you will be collected, stored, and used exclusively for processing your contacting of us, i.e. especially for processing a general query made by you via the contact form, a registration request for protected access made by you, or for processing and executing a contract previously concluded or a contract request made by you via the website.

Your e-mail address is also used by us exclusively for the purpose for which you contacted us via the website. Only if expressly desired by you and in compliance with the consent granted by you will we also send you e-mails containing general information and advertising beyond the purpose for which you contacted us. Your consent to this additional use of your e-mail address may of course be revoked at any time by you by sending an e-mail or by writing to the address set out in the Imprint. We will also inform you of this in each e-mail containing general information or advertising.

5. Transmission of Data

Our employees obtain access to your data if they need it for fulfilling contractual and legal obligations. The service providers and third parties engaged by us to perform our contractual obligations may also receive data for such purposes provided that the data protection provisions on this are being complied with. These include, among others, commercial enterprises in the categories waste disposal, waste-disposal services, consulting, and sales and marketing.

With respect to the transmission of data to recipients external to Zentek, data may generally only be transmitted if the law demands such, if an outsourced data processing relationship exists, or if consent has been given. The transmission of your data to a non-EU country or to an international organisation is effected in compliance with the law. The extent of such transfer is limited to the minimum required for achieving the particular purpose.

6. Length of Storage

Zentek processes and stores your personal data as long as required for fulfilling our contractual and legal obligations (under commercial law and tax law, generally two- to ten-year storage obligations; the statutory limitation periods are three to thirty years). After this time, the data is generally deleted.

7. Creating Usage Profiles

For improving the website and for advertising and market-research purposes, Zentek analyses the behaviour of the users of this website. Zentek creates anonymised usage profiles for this purpose unless you object to this. Zentek ensures that the anonymised usage profiles are not combined with your personal data. You can object to the creation of an anonymised usage profile by sending an e-mail or by writing to the person named in the Imprint.

8. Data Protection Rights

Zentek will provide you at any time with information about the personal data stored by us about you and will do so free of charge, without undue delay, and in compliance with the statutory provisions on this. In this regard, please contact the persons named in the Imprint or the data protection officer.

Every data subject also has the right to rectification, the right of erasure, the right to restriction of processing, the right to object in individual cases, the right to object to the processing of data for direct advertising purposes, and the right to data portability.

Data subjects are entitled to lodge complaints at any time with a competent supervisory authority for data protection.

9. Transmission of Data

For performing a contract as contemplated by Article 6(1) sent. 1(b) GDPR, Zentek transmits your data to the transport enterprise commissioned with the delivery to the extent required for delivering the ordered goods. Depending on which payment service-provider you choose in the ordering process, Zentek transmits, for the purpose of payment processing, such payment-related data to the bank commissioned with the payment and if applicable to the payment service-provider commissioned by us or to the chosen payment service-provider. The chosen payment service-provider sometimes collects this data itself if you have set up an account with them. In such cases you must, during the ordering process, login with the payment service-provider using your login credentials. The data protection declaration of the respective payment service-provider applies in such cases.

Zentek commissions a payment service-provider domiciled in a country outside the European Union. The transmission of personal data to this enterprise is effected solely to the extent required for fulfilling the contract.

Transmission of Data to Debt-Collection Enterprises

For performing the contract as contemplated by Article 6(1) sent. 1(b) GDPR, Zentek transmits your data to a commissioned debt-collection enterprise in cases where our payment claim has not been satisfied despite a previously effected demand for payment. In such cases, the debt claim is collected directly by the debt-collection enterprise. In addition, the transmission serves to safeguard, pursuant to a weighing of interests, our overriding legitimate interests in an effective assertion and enforcement of our payment claim as contemplated by Article 6(1) sent. 1(f) GDPR.

Payment Processing by BS PAYONE

Zentek has commissioned BS PAYONE GmbH, Fraunhoferstraße 2-4, 24118 Kiel, Germany with the processing of payments (PayPal, SEPA direct debit, bank transfer). To this end, BS PAYONE GmbH requires, among other things, your name, postal address, bank account number and bank code number or credit card number (including the validity period), invoice amount, currency, and transaction number. BS PAYONE GmbH is entitled to use this information for the purposes of processing payment and is entitled to transmit it to us. BS PAYONE GmbH is obligated to handle such information in compliance with data protection laws. The provider of this website uses services of etracker GmbH from Hamburg, Germany (https://www.etracker.com) to analyze usage data. We do not use cookies for web analysis by default. Insofar as we use analysis and optimization cookies, we obtain your explicit consent separately in advance.
